Furthermore, the monetary portion contributed by one of the homeowners is generally not significant compared to the value of the exchanged property; the contract is always treated solely as an exchange (and does not include a purchase-sale agreement).

Once the parties agree to the transfer of assets and voluntarily close the deal, the formalization of everything proceeds before a notary.

However, the process regarding expenses and taxes can complicate the transaction. For instance, if there are mortgages on one or both assets, a new mortgage must be approved or a renewal must be carried out to reflect a change in the debtor's name.

When there's a change of ownership for any of the mortgaged properties, the mortgage continues, albeit under the name of the new debtor-owner. And, if this person has good financial solvency, then there's a higher chance that the financial institution will approve the mortgage.

Steps to complete a home exchange

The procedure is quite straightforward. Of course, this is the case when there are no outstanding mortgage debts.

  • Agree on the value of the properties (market or appraisal value)
  • Determine if one property is worth more than the other
  • Pay the difference between the properties (if applicable)
  • Sign the deed 

After completing all these steps, all that remains is to transfer ownership of both properties. This way, each user will meet their needs.

When is it used?

These types of legal procedures are used when homeowners want to move to another property without losing much time and don't wish to pay large sums of money to buy another asset.

This legal procedure involves several costs. Some of the most significant are:

  • Notary and registration of the public deed.
  • Associated taxes, such as ITP (which is 7%) and municipal capital gains tax.
  • Loss or gain of patrimonial benefits in Personal Income Tax.

It should be noted that, in certain cases, novation expenses must be considered, but only if there are mortgages associated with one or both properties. This is necessary to formalize the transfer of ownership.How long does the process take?This process can vary depending on several determining factors. For example, the most common ones are:

  • Contract drafting. This is usually a quick process and typically takes a few days if the parties are available and all documentation is prepared.
  • Appraisal. This activity can take up to a week, but it depends on the availability of the appraisers.
  • Negotiation. This procedure can take a few days or several weeks.
  • Notary signing. This step only requires one day.
  • Registration. This step can take a few additional days.

If everything goes smoothly, the process can take anywhere from a few weeks to several months. There isn't really a precise timeframe.

How to declare an exchange for tax purposes?

If there are capital gains or losses they must be included in your tax return. In that case, you must calculate it based on the difference between the acquisition value of the house and the market value, the right given, or what you receive in exchange.

Can a home exchange be done with a mortgage?

Yes, it is possible to carry out this process if one or both assets have a mortgage. In that case, you must perform a novation. And for the purpose of the asset's value, you need to calculate it by subtracting the market value from the outstanding principal balance of the mortgage.
