On the other hand, the monetary fraction given by one of the owners of the property is generally not significant in relation to the value of the property being exchanged; the contract is always treated solely as a barter (and does not include a purchase and sale agreement).

Once the parties agree to the transfer of assets and voluntarily close the deal, the formalization of everything before a notary public proceeds.

However, the way expenses and taxes work can complicate the transaction. For example, if there are mortgages on one or both assets, a new mortgage must be approved or a renewal must be carried out in which a change of debtor is included.

When there is a change of ownership of any of the assets covered by the mortgage, the mortgage continues, although under the name of the other debtor owner. And, if this person has good financial standing, then there is a greater chance that the financial institution will approve the mortgage.

Steps for exchanging homes

The procedure is quite simple. Of course, this is the case when there are no outstanding mortgage debts.

  • Agree on the value of the properties (market value or appraised value)
  • Assess whether one property is worth more than another
  • Pay the difference between the goods (if applicable)
  • Sign the deed 

After completing all these steps, all that remains is to transfer ownership of both assets. This way, each user will have their needs met.

When is it used?

  • Appraisal. This process can take up to a week, but it depends on the availability of the appraisers.

  • Signing before a notary. This step only takes one day.

If everything goes smoothly, the process can take anywhere from a few weeks to a few months. In reality, there is no precise time frame.

How to declare a swap on your tax return?

If there are capital gains or losses, they must be included in your tax return. In this case, you must calculate the difference between the purchase price of the house and the market value, the right transferred, or the amount you receive in exchange.

Can you exchange a home with a mortgage?

Yes, it is possible to carry out this procedure if one or both assets have a mortgage. In that case, you must perform a novation. And for the purposes of the asset value, you have to calculate it by subtracting the market value from the outstanding capital of the mortgage process.
