August 18, 2025

Home swapping is a contract that more and more citizens are entering into, and it serves as a mechanism for those who want to move house. Given that it has become a viable alternative in recent years, especially after the boom of nearly 7,000 transactions, it is not surprising that some people want to know what it is all about.

For this reason, in the following lines we explain what it is, how it works, how long it lasts, and other relevant aspects you should understand about this topic. Keep reading!

What Is a Home Exchange?

In simple terms, it is an exchange of properties of equal or similar value. In this case, two owners voluntarily agree to the exchange. However, although it is related to a conventional transaction, it is not like a property purchase agreement, where a large amount of money changes hands.

Características

There are some important characteristics of this type of contract that you need to be aware of. The most important ones are as follows:

Legal Formalization

This process is formalized through a public deed. This document includes a description of the transfer and the assets, as well as the value of each one.

Taxes

As with other types of transactions, this formality is subject to taxation. For example, the Property Transfer Tax.

Simplicity

This contract becomes valid once you appear before a notary. It does not require additional formalities, as is the case with other contracts (unless there are mortgages involved).

Bilaterality

Both parties acquire the same obligations, since the process is reciprocal. This means that each party is aware of their obligation to comply with what is established in the contract.

Agile Process

This process is usually quite agile and faster compared to a conventional purchase and sale. Why? Simply because there is no need to wait for financing approval or to find a buyer for the house.

Types

Basically, there are two types of property swaps related to real estate transactions. These are as follows:

Pure

This is a transaction in which the exchanged goods have an equivalent value. In other words, neither party has to contribute any additional monetary amount.

Mixed

It consists of a transaction in which one of the assets exceeds the value of the other. For this reason, one of the owners must pay the difference in cash.

How does it work?

Both parties must contribute a property. However, since the valuation of both properties is not usually the same, one of the owners must contribute some money.

On the other hand, if the monetary portion given by one of the property owners is generally not significant compared to the value of the property being exchanged, the contract is always treated solely as a swap (and does not include a purchase and sale).

Once the parties agree on the transfer of the assets and voluntarily close the deal, the formalization of everything before a notary proceeds.

However, the way expenses and taxes work can complicate the transaction. For example, if there are mortgages on one or both properties, a novation must be approved or a renewal carried out in which a change of debtor appears.

When there is a change of ownership of any of the assets covered by the mortgage, the mortgage continues, although under the name of the new debtor. Additionally, if the person has a good financial standing, there is a greater chance that the financial institution will approve the mortgage.

Steps for Exchanging Homes

The procedure is quite simple. Of course, this applies when there are no outstanding mortgage debts.

  • Agree on the value of the properties (market value or appraised value).
  • Assess whether one property is worth more than the other.
  • Pay the difference between the properties (if applicable).
  • Sign the deed

After completing all these steps, all that remains is to transfer ownership of both assets. This way, each user will have their needs met.

When is it used?

This type of legal procedure is used when homeowners want to move to another home without investing too much time and without needing to pay large sums of money to purchase another asset.

A property swap is also useful in cases where beneficiaries do not want to go through the process of finding a buyer for their current home. It is even a procedure that can be used to obtain a property at a reduced cost, at least in terms of taxes.

What Costs Are Associated with This Contract, and Who Pays Them?

This legal procedure involves several expenses. Some of the most important are as follows:

  • Notary and registration of the public deed.
  • Associated taxes, such as ITP (which is 7%) and municipal capital gains tax.
  • Loss or gain of capital gains in personal income tax.

It should be noted that, in certain cases, novation costs must be taken into account, but only if there are mortgages associated with one or both properties. This must be done in order to formalize the transfer of ownership..How long does the process take? This process can vary depending on several determining factors. For example, the most common ones are:

  • Drafting the contract. This is usually a quick process and typically takes a few days if the parties are available and all the documentation is ready.
  • Appraisal. This process can take up to a week, but it depends on the availability of the appraisers.
  • Negotiation. This process may take a few days or several weeks.
  • Signing before a notary. This step only takes one day.
  • Registration. This step may take a few additional days.

If everything goes smoothly, the process can take anywhere from a few weeks to a few months. In reality, there is no precise time frame.

How to Declare a Property Swap on Your Tax Return?

If there are capital gains or losses, they must be included in your tax return. In this case, you must calculate the difference between the acquisition value of the property and the market value, the right transferred, or the amount received in exchange.

Can You Exchange a Home with a Mortgage?

Yes, it is possible to carry out this procedure if one or both parties have a mortgage. In that case, a novation must be executed. For valuation purposes, you must calculate the asset value by subtracting the outstanding mortgage principal from the market value in the mortgage process.

Advantages and Disadvantages of a Property Swap

There are some advantages and disadvantages that you should consider when formalizing this contract. These are as follows:

Advantages

  • Faster process
  • Customized agreements
  • Cost savings

Disadvantages

  • Possibility of unequal valuations
  • Possibility of legal complications due to unclear terms
  • Complications in finding a property that fits your personal preferences and whose owner is willing to exchange it for yours.
